RPI/CPI JUDICIAL REVIEW LATEST
Officials will be aware that the FBU has launched a legal challenge to the governmentâ€™s imposed change of the way pensions are uprated.
Since April 2011 public sector pensions will be uprated using the Consumer Price Index (CPI) rather than the Retail Price Index (RPI), which will devalue the future pension benefits by around 15%. The FBU were instrumental in launching this challenge with 3 other unions, POA, NASUWT and PCS, an action that has now been more recently joined by Unison and Unite.
Thompsons solicitors have informed us that they have now received the Defendants’ Acknowledgment of Service.Â This means that they do not contest the grant of permission to apply for judicial review.
The court has, of 5th July 2011, formally granted the Claimants permission to apply for judicial review.
There will be an exchange of bundles, documents and skeleton arguments between 29th July and 10th August in readiness for a trial starting on 25 October 2011.
